This seems like the rules issue that can easily be reproduced. The rules are written in a confusing way but this one seems to be very clear to follow.

The commander can choose only a value or double value or choose all the dices with points as one way.

The rules says that after rolling, you should group dices according to rolled results and then you choose one or more groups an use *all* the dices in these groups; that's why you were able only to use both "3" dices you have rolled. So there rules weren't broken in the BGA version.
