I had 8 military and should have been able to use Imperium Gem Prospectors power to discard a rare element good and gain +2 military to settle Rebel Stronghold
The linked report is related only to the error message displayed when attempting to conquer a world with a military bonus but not enough colonists. You didn't encounter this because you had no other settle actions available so the game just skipped to giving you two colonists.
