First, I must say, that the designer is mathematically wrong. Highest value means absence of a higher value. It is completely natural to have multiple highest cards, i.e., when they all show the same highest value.
Second, if the designer wanted to disallow ties, why didn't he phrase the mission as "The third card played must have a higher number than all other cards." just like Mission 8 ("The last card played must have a higher number than all other cards.") or Mission 22 ("The third card played must have a lower number than all cards played.") Instead, he used a completely different wording.
