I think this is working as designed. If you look at the rules for Hearts, you'll see this:
"Playing the queen of spades also counts as breaking hearts, because that card is a penalty card..."
So even though no hearts had been played, the queen was, and that's a point card so it counts. Hearts can then be led.

I don't know it was you who conceived the game but I would change that rule adapting it to traditional herts

It's the way I've always played Hearts... I didn't even know the queen didn't "count" as breaking hearts! I think it's maybe one of those things where some people play this way, and others don't.
I guess I could update the game options so "traditional" Hearts includes that rule...

I've updated the "Traditional Hearts" mode (one of the game options) so if that's selected, the queen of spades does NOT count as "breaking hearts".
